Duchesne County Man Charged In 2023 Murder Of Wife Found Incompetent To Stand Trial

The trial of a Duchesne County man charged in the 2023 murder of his wife has been delayed as his most recent review has found him to be incompetent. In the fall of 2023, the Duchesne County Sheriff’s Office shared that they had responded to the Arcadia area of Duchesne County in response to Brent Nello Gilbert calling dispatch and stating that he had killed his wife. When deputies arrived on scene they found the deceased body of his wife Stacey Gilbert. Brent Gilbert was taken into custody and transported to the Uintah Basin Medical Center for treatment of a self-inflicted injury to his wrist. He was then transported to the Duchesne County Jail and booked for Aggravated Murder. Two psychiatric evaluations found Gilbert competent to stand trial. With Gilbert’s trial approaching this year, the parties appeared via Webex in February and Gilbert and his lawyer brought forth issues of him not being able to fully understand conversations. The judge terminated the plea and had Gilbert transported to the Utah State Mental Hospital for further evaluation on competency with a review scheduled for the end of April. During that review, the parties went over the mental evaluation and Gilbert was deemed incompetent with no substantial probability of restoration of his mental health within the foreseeable future. On May 5th, another Webex hearing was held and the judge officially found Gilbert incompetent to proceed at this time and another competency review hearing is scheduled for July.
