Competency Evaluation Underway for Basin Man Charged With Enticing Boy

A competency evaluation is underway in a case of a Uintah County man arrested February 28th in Salt Lake City and charged with 3rd Degree Felony Enticing of a Minor by Internet or Text Message. Court documents outline a disturbing correspondence by text message between 30-year-old Donald Flayne Massey and a 10-year-old North Carolina boy. Vernal Police began their investigation after being contacted by a Detective in North Carolina on February 7th. On March 7th Massey was granted bail with specific stipulations that he live with his parents, have no access to Internet service at the home or on any device and that he have no contact with children. Counsel also indicated in court that day their intent to file a motion to determine competency and a status hearing was scheduled for
April 17th.
Court documents show that the ‘Inquiry into Sanity of Defendant’ and ‘Not Guilty by Reason of Insanity/Diminished Capacity’ evaluation was accepted by the Forensic Evaluator for the Utah State Courts on March 27th. It states that the evaluator then has 30 days to submit the report to the Court and appropriate parties.
