Court documents provide details on what led up to an officer involved critical incident that happened on April 15th in Duchesne County and the charges that have since followed. According to the Probable Cause Statement, West Valley City Police Department received a call for service regarding a potentially suicidal individual. He reportedly had been consuming alcohol while saying goodbye to his family by phone and that he was seen leaving the place where he was at with a firearm. An “Attempt to Locate” was broadcast to West Valley City and the surrounding area. A second “Attempt to Locate” was broadcast in the Uintah Basin after a friend called in and indicated that the potentially suicidal individual may be traveling to Bandana Ranch in Duchesne County. A third “Attempt to Locate” was dispatched after a person reported seeing a black pickup truck driving recklessly on Highway 40 traveling east towards Duchesne. A Division of Natural Resources Officer located the vehicle and conducted a traffic stop after observing the truck swerving across the road. The Officer contacted the driver, who appeared to be under the influence with an open container of alcohol in the vehicle’s center console. The Officer stated that the man was slow to respond and had slurred speech and erratic behavior. The man informed the Officer that he was armed and indicated that he would kill himself or that the Officer would have to “do it for him”. He then produced a handgun and pointed it at the Officer. “A use-of-force incident by the officer then took place and is currently being investigated by the State Bureau of Investigation.” The man was taken into custody and provided with immediate medical care. During a search of the man’s vehicle, several open Bud Light cans were found and a handgun was located on the passenger side of the vehicle. 42-year-old Joshua David Boggess is charged with 3rd Degree Felony Aggravated Assault, DUI, Carrying a Dangerous Weapon Under the Influence of Alcohol, among other charges. Boggess is an alcohol restricted driver from a previous DUI conviction.
