Charges have been filed against a repeat DUI offender in Vernal. According to the Probable Cause Statement, an officer observed Wayne Ussery driving a vehicle and the officer knew that he had a suspended driver’s license. When asked by the officer, Ussery stated that he knew his license was suspended. It was also noted that the vehicle did not have an ignition interlock which was required as Ussery is an alcohol restricted driver. The officer attempted to perform field sobriety testing but Ussery was not able to complete any of the tests. Ussery was positive for alcohol on a Preliminary Breath Test and admitted to using medical marijuana prior to driving. It was determined that Ussery was under the influence of alcohol and drugs to a point where he was not safe to operate a vehicle. 65-year-old Wayne Ussery is charged with 3rd Degree Felony DUI due to having a prior felony DUI, as well as other Misdemeanor charges.
