Proposed Pipeline To Divert Water From Green River To CO Again Rejected

A proposed pipeline that would divert water from the Green River to Colorado has not received the support of the Utah Supreme Court. An ABC4 report shared on Tuesday that the Supreme Court ruled on October 17th in favor of the original decision by the Utah State Engineer to reject the proposed project. Water Horse Resources proposed the pipeline in 2018 focused on diverting 55,000 acre-feet of Green River water each year to Colorado. After the state engineer rejected the proposal in 2020, Water Horse appealed to a district court that said Water Horse had not provided evidence that the water would be put to beneficial use if diverted to Colorado. Last week’s Supreme Court decision backed up the State Engineer and district court, stating, “Water Horse failed to establish a reason to believe that the exported water can be put to beneficial use in Colorado. The district court correctly declined to disturb the state engineer’s decision.”
