On February 9th, Officers responded to a report of an assault in Neola that ended in arrest. According to the Affidavit of Probable Cause, Brian Foote had a dispute with an elderly family member and punched the 77-year-old man in the chest multiple times before throwing him on the floor where he continued to hit and kick him. Officers spoke with the victim who said he had purchased a generator from Brian for $500 dollars but Brian recently told him he was going to sell the generator which the man told him he could not do as he had purchased it from him. Brian claimed the man only paid $450 dollars and began assaulting the man when he did not agree. Foote told officers there was a dispute over a debt and admitted he hit, kicked, and threw around the victim.  47-year-old Brian Carl Foote was arrested and is charged with 3rd Degree Felony Aggravated Assault.
