The Uintah County Republican Party Central Committee adopted last week a ‘Resolution Calling for the Impeachment of Judge Dianna M. Gibson for Malfeasance in Office’ and has urged Uintah County residents to reach out to elected representatives to file articles of impeachment in the House and try in the Senate. “This week Judge Diana Gibson directed the State of Utah to adopt a congressional district map that was never beholden to public scrutiny and in direct violation of the Utah State Constitution which gives the legislature explicit authority to adopt congressional maps,” shares the message. Resolution Calling for the Impeachment of Judge Dianna M. Gibson for Malfeasance in Office
WHEREAS
Article IX, Section 1 of the Utah Constitution explicitly states that “the Legislature shall divide the state into congressional, legislative, and other districts” following each federal enumeration, thereby granting the Legislature the exclusive constitutional authority over the establishment of district boundaries; and
WHEREAS
Utah voters in 2018 adopted Proposition 4, creating an advisory Independent Redistricting Commission to recommend maps to the Legislature; and the Legislature, in keeping with constitutional limits, enacted compromise legislation ensuring that the commission’s role would remain advisory and subordinate to legislative authority; and
WHEREAS
The Utah Legislature lawfully enacted new congressional maps in 2021 and, after a judicial challenge, reconvened in special session in the fall of 2025 and passed S.B. 1012 which adopted a revised map (Map C) in compliance with the court’s prior order and in time for the Lieutenant Governor’s November 10, 2025 administrative deadline to prepare for the 2026 election cycle; and
WHEREAS
On November 10, 2025, at approximately 11:40 p.m., Utah District Court Judge Dianna M. Gibson issued an order which:
1. Declared S.B. 1012 (Map C) unconstitutional and enjoined its implementation; 2. Approved “Plaintiffs’ Map 1”—a map drawn by private litigants, not by any elected body; and
3. Ordered the Lieutenant Governor to implement that map for Utah’s congressional elections “until another validly enacted legislative plan takes effect or as otherwise ordered by an appellate court”; and
WHEREAS
Judge Gibson’s order, by mandating the implementation of a litigant-drafted map that was neither enacted by the Legislature nor subjected to public scrutiny or constitutional process, constitutes a usurpation of legislative power in direct violation of Article IX, Section 1 of the Utah Constitution; and
WHEREAS
Such an act represents judicial malfeasance and abuse of office, undermining the constitutional separation of powers and the sovereignty of the people of Utah as exercised through their duly elected Legislature; and
WHEREAS
Article VI, Section 19 of the Utah Constitution provides that “the Governor and other State and Judicial officers shall be liable to impeachment for high crimes, misdemeanors, or malfeasance in office,” and that impeachment judgment may extend to removal and disqualification from office; and
WHEREAS
Article VI, Sections 17 and 18 further provide that impeachment shall be initiated by the Utah House of Representatives upon a two-thirds vote and tried by the Utah Senate, also requiring a two-thirds concurrence for conviction;
NOW, THEREFORE, BE IT RESOLVED
That the Uintah County Republican Party Central Committee finds that Judge Dianna M. Gibson’s November 10, 2025 order constitutes an unconstitutional overreach and malfeasance in office, and calls upon the Utah House of Representatives to initiate articles of impeachment pursuant to Article VI of the Utah Constitution.
BE IT FURTHER RESOLVED
That the Central Committee urges the Utah Senate to fulfill its constitutional duty to try such impeachment and, upon due consideration of the evidence, to remove Judge Gibson from judicial office should malfeasance be confirmed.
