The Utah Department of Natural Resources Division of Law Enforcement issued an update on May 17th regarding the Officer-Involved Critical Incident that took place on April 16th in Duchesne County. Court documents report that an “Attempt to Locate” was broadcast in the Uintah Basin after it was indicated that a potentially suicidal West Valley man could be traveling to Bandana Ranch in Duchesne County. Another “Attempt to Locate” was dispatched after a person reported seeing a black pickup truck driving recklessly on Highway 40 traveling east towards Duchesne. A Division of Natural Resources Officer located the vehicle and conducted a traffic stop after observing the truck swerving across the road. The Officer contacted the driver, who appeared to be under the influence with an open container of alcohol in the vehicle’s center console. The Officer stated that the man was slow to respond and had slurred speech and erratic behavior. The man informed the Officer that he was armed and indicated that he would kill himself or that the Officer would have to “do it for him”. He then produced a handgun and pointed it at the Officer. “A use-of-force incident by the officer then took place.” The man was taken into custody and provided with immediate medical care. The May 17th update stated that the individual involved, Joshua Boggess, was moved on May 13th from a Salt Lake County Hospital to the Duchesne County Jail and was booked on criminal charges. 42-year-old Joshua David Boggess is charged with 3rd Degree Felony Aggravated Assault, DUI, and Carrying a Dangerous Weapon Under the Influence of Alcohol, among other charges. Boggess is an alcohol restricted driver from a previous DUI conviction. The Department of Public Safety, State Bureau of Investigations is leading the investigation.
